New Tariffs of Government Fees in Mexico

Today, Thursday April 26, 2018 it has been published in the National Official Diary a new decree by which the tariff of government fees of the Mexican Patent Office (IMPI) is amended.  New tariffs will be in force tomorrow Friday 27, 2018.

The main aim for making this was to include the new tariffs related to Geographical Indications, Indications of Origin and for renewal of Industrial Designs derived from the recent amendments to the IP Law, which entered in force this very same day, see our Newsletter No. 3 (March 2018), IMPI has taken this opportunity to amend the initial fees for filing patents, utility models and industrial designs, as well.

IMPI will start charging extra fees for the number of pages per application in excess of the first 30 pages, regarding Patents and Utility Model applications. In the case of the Industrial Designs applications, extra fees will apply for each of the additional embodiments contained in a single application. Same government fees will apply for any Divisional application in the three cases.

The rationale behind these new government fees is to standardize IMPI’s tariff with the practices of the top international Patent Offices, including government fees.    In order to minimize the impact of the new tariff regarding extra pages, IMPI has reduced the initial fee for filing patents, utility models and industrial designs.

The new tariffs are as follows:

IMPI fees for filing an ordinary/regular patent application including up to 30 pages. $352 USD
IMPI fees for each additional page (from 31). $4.7 USD
IMPI fees for entry into the National Phase of a PCT application under Chapter I including up to 30 pages. $243 USD
IMPI fees for each additional page (from 31). $4.7 USD
IMPI fees for entry into the National Phase of a PCT application under Chapter II including up to 30 pages. $116 USD
IMPI fees for each additional page (from 31). $4.7 USD
IMPI fees for filing a utility model application including up to 30 pages. $155 USD
IMPI fees for each additional page (from 31). $4.7 USD
IMPI fees for entry into the National Phase of a PCT utility model application under Chapter I including up to 30 pages. $155 USD
IMPI fees for each additional page (from 31). $4.7 USD
IMPI fees for entry into the National Phase of a PCT utility model application under Chapter II including up to 30 pages. $105 USD

IMPI fees for the issuance of the Letters Patent of a utility model. $52 USD
IMPI fees for filing a Layout Design of Integrated Circuits including up to 30 pages, until the end of the procedure or the issuance of the Letters Patent. $81 USD

IMPI fees related to the appellations of origin and geographical indications will be as follows:
IMPI fees for analyzing a request for a general declaration of protection for an appellation of origin or a geographical indication, as well as for the modification request to a general declaration in force. $120 USD
IMPI fees for the authorization for using an appellation of origin or a geographical indication, as well as its renewal, per action. $63 USD
IMPI fees for registering a permission to use an appellation of origin or a geographical indication, granted by the authorized user. $47 USD
IMPI fees for analyzing an opposition to a request for a general declaration of protection for an appellation of origin or a geographical indication, as well as for an opposition to a modification request of general declaration in force. $289 USD
IMPI fees for the registration of the recognition of an appellation of origin or geographical indication protected abroad. $26 USD
